1. Introduction
Welcome to Launch7. These Terms of Service ("Terms") govern your use of our website design, development, hosting, and maintenance services ("Services") provided by Defikra FZE, a Free Zone Establishment registered in Sharjah Publishing City Free Zone, United Arab Emirates ("we," "us," or "our").
By engaging our Services, you ("Client," "you," or "your") agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
2. Definitions
- Services: Website design, development, hosting, and maintenance services provided by Launch7.
- Deliverables: The website, design files, code, and any other materials created as part of the Services.
- Project: The specific scope of work agreed upon between Launch7 and the Client.
- Launch Week: The designated week during which your website will be designed, developed, and delivered.
3. Services Description
3.1 Website Design & Development
We provide custom website design and development services. Each website is built from scratch and tailored to your specific needs. We do not use templates. Our services include:
- Custom website design
- Professional copywriting
- Responsive development for all devices
- Search engine optimization (SEO) setup
- Analytics integration
3.2 Hosting & Maintenance
Your first year of hosting and support is included with your website package. This includes:
- Website hosting on secure, fast servers
- SSL certificate for secure connections
- Minor content updates and edits
- Technical support via email
After the first year, hosting and maintenance services are available through a separate subscription agreement. You may choose to host the website yourself or with another provider. The website and all associated code are yours.
4. Client Responsibilities
To ensure successful delivery of your website, you agree to:
- Complete the onboarding questionnaire with accurate information about your business and goals
- Provide any requested materials (logos, brand assets, photos) in a timely manner
- Review and provide feedback on designs within the agreed timeline
- Respond to communications within 48 hours during the project
- Provide final approval before the website goes live
Delays in providing materials or feedback may extend your project timeline beyond 7 days.
5. Payment Terms
5.1 Pricing
All prices are listed on our website and are payable in the currency specified at checkout. Prices may change, but confirmed bookings will be honored at the quoted price.
5.2 Payment Processing
Payments are processed securely through Stripe. We accept major credit and debit cards. By making a payment, you agree to Stripe's terms of service.
5.3 Payment Schedule
Full payment is required at the time of booking to secure your Launch Week. Your project will not begin until payment is received in full.
5.4 Refunds
If you cancel before your Launch Week begins, you are entitled to a full refund minus a 10% administrative fee. Once your Launch Week has started, refunds are not available as work will have commenced on your project.
6. Intellectual Property
6.1 Ownership
Upon receipt of full payment, you own all rights to the final Deliverables, including:
- The website design
- All custom code written for your project
- Content created specifically for your website
6.2 Portfolio Rights
We reserve the right to display your completed website in our portfolio and marketing materials unless you notify us in writing that you prefer to opt out.
6.3 Third-Party Assets
Any third-party assets (fonts, stock images, icons) used in your website are licensed according to their respective license terms. We will ensure all assets used are properly licensed for your use.
7. Revisions & Approval
7.1 Review Phase
The review phase begins when we deliver your first draft and lasts for 14 days. During this period, you may request unlimited revisions at no additional cost.
7.2 What Counts as a Revision
Revisions include adjustments to:
- Colors, fonts, and visual styling
- Layout and spacing
- Text and copy changes
- Image placement and sizing
7.3 What Is Considered New Scope
The following are not covered under unlimited revisions and may incur additional charges:
- Additional pages beyond the original package
- New features or functionality not discussed during onboarding
- Complete redesigns after initial design direction was approved
- Revisions requested after the 14-day review phase
7.4 Approval & Completion
The website will not go live until you provide written approval. Once approved, the website is considered complete. Changes requested after approval are subject to our standard hourly rate or may be included in your hosting and maintenance subscription.
8. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability for any claims arising from the Services shall not exceed the total amount paid by you for the specific project in question.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
- We are not responsible for any issues arising from your use of the website after delivery, including but not limited to changes made by you or third parties.
9. Warranties & Disclaimers
We warrant that the Services will be performed in a professional and workmanlike manner. The website will be delivered free from material defects and will function as demonstrated during the approval process.
We do not guarantee specific business results, search engine rankings, or traffic increases. Website performance depends on many factors outside our control.
10. Termination
10.1 Termination by Client
You may cancel your project before your Launch Week begins for a refund as described in Section 5.4. After your Launch Week begins, the project may not be cancelled.
10.2 Termination by Us
We reserve the right to terminate a project if:
- You fail to provide necessary materials or feedback within reasonable timeframes
- You breach these Terms
- We determine in good faith that we cannot meet your requirements
In the event we terminate the project, you will receive a refund proportional to the work not yet completed.
11. Hosting Subscription
After the first year of included hosting, you may choose to continue hosting with us through an annual subscription. Subscription terms:
- Subscriptions renew annually unless cancelled
- You may cancel at any time before the renewal date
- Upon cancellation, you will receive all files needed to host your website elsewhere
- We will provide reasonable assistance in migrating to another host
12. Governing Law & Disputes
These Terms are governed by the laws of the United Arab Emirates and the Emirate of Sharjah. Any disputes arising from these Terms or the Services shall be resolved through the courts of Sharjah, UAE.
Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation.
13. Changes to These Terms
We may update these Terms from time to time. The updated version will be indicated by an updated "Last updated" date. Your continued use of the Services after any changes constitutes acceptance of the new Terms.
